The agreement

What you're agreeing to.

These Terms of Service (“Terms”) form a binding agreement between you and Edustack Technologies Private Limited, registered in India at B130, AFOCHS, Sainikpuri, Hyderabad, Telangana, India — 500094 (“Oyku”, “we”, “us”).

By creating an account or using the Oyku mobile application or website (the “Service”), you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

Who can use Oyku

Adults, on behalf of children.

Oyku is built for adults — parents, guardians, teachers, and authorised school staff — who participate in a child's school life. By using the Service, you confirm that you are at least 18 years old and legally able to enter into this agreement.

If you are a parent or guardian, you represent that you have the authority to consent to a child's presence on Oyku, in line with the school's policies and applicable law. Children under the age of majority should not use the Service directly.

Accounts

Your account, your responsibility.

  • Sign in to Oyku is by phone number and PIN. Keep your PIN private and don't share it with anyone.
  • Notify us at hello@oyku.app immediately if you suspect unauthorised access to your account.
  • Provide accurate information when you sign up, and keep your contact details up to date so we can reach you about your child's classroom activity.
  • You are responsible for activity on your account, including content posted by people you allow to use it.

Acceptable use

Be kind. Keep children safe.

When you use Oyku, you agree not to:

  • Upload, share, or screenshot content involving children outside what your school has approved.
  • Use Oyku to harass, bully, defame, or single out a child, family, teacher, or school.
  • Reverse engineer, scrape, or attempt to access parts of the Service you are not authorised to access.
  • Interfere with the security or operation of the Service or its users.
  • Use Oyku for unlawful purposes, or in a way that violates a school's policies or applicable law.

We may suspend or terminate accounts that violate these standards, and we'll cooperate with schools and authorities where the safety of a child requires it.

Content & licences

Who owns the photos.

Schools and teachers

Schools and teachers retain ownership of the classroom photos, videos, and captions they upload. They grant Oyku a worldwide, non-exclusive licence to host, display, and process that content for the limited purpose of operating the Service for their school community — including delivering memories to the right parent feed and producing the optional yearly photo book.

Parents

Parents are licensees of the memories they receive through the Service. You may view, react, comment within the Service, and receive a yearly bound photo book; you do not gain ownership of other people's photos or the right to redistribute them outside Oyku.

Reference photos

When a parent uploads an optional reference photo of their child, they grant Oyku a non-exclusive licence to use it solely for matching that child's memories inside Oyku. Parents may withdraw this consent and request deletion at any time.

A simple promise: we won't use your photos to train third-party AI models, advertise to your family, or sell access to anyone outside Oyku.

Schools

School-led, parent-trusted.

Schools deploying Oyku for their community agree to a separate school agreement covering data handling, parent consent, opt-out lists, content approval, and the boundaries of public sharing. Where a school agreement exists, the school's instructions and consent workflow take precedence over generic user behaviour for content shared inside its classrooms.

Payments & photo books

Subscriptions and printed books.

Some Oyku features are free for parents while a child's school subscription is active. Optional add-ons such as the yearly printed photo book may be priced and offered through schools, parents, or Apple/Google in-app purchases as applicable. Pricing, delivery, and refund terms for printed products will be presented before any purchase.

Where the Service is provided free of charge, it is provided “as is” — without any commitment of paid support, uptime, or feature continuity beyond what is required by law or contract.

Third-party services

The platforms underneath.

Oyku runs on top of cloud and platform services such as Apple, Google, AWS, and others. Their platform terms (App Store, Google Play, push notification services, cloud providers) also apply to your use of the Service. We choose vendors carefully and review their security, but their availability and behaviour are outside our direct control.

Termination

Leaving Oyku, and what happens next.

You can stop using Oyku at any time and delete your account from the in-app Profile screen, or by emailing privacy@oyku.app. See our Support page for the step-by-step.

We may suspend or terminate accounts that violate these Terms, put a child or other user at risk, or where required by a school agreement, law, or court order. On termination, your access ends; certain school-level audit logs may be retained for the period required by applicable law.

Warranties & liability

The honest legal bit.

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Oyku disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

Oyku will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption, arising out of or related to your use of the Service. Our aggregate liability for any claim arising out of or related to the Service is limited to the greater of (a) the amounts you paid Oyku in the twelve months preceding the claim, or (b) ₹5,000.

Nothing in these Terms limits liability that cannot be limited under applicable law (for example, liability for fraud or certain consumer rights).

Changes to these Terms

When we update them.

We may update these Terms as Oyku evolves. We'll update the “Last updated” date at the top, and material changes will be highlighted in-app or by email/notification before they take effect. Continuing to use the Service after a change means you agree to the updated Terms.

Governing law

Where disputes are heard.

These Terms are governed by the laws of India, without regard to its conflict-of-law rules. The courts at Hyderabad, Telangana, India will have exclusive jurisdiction over any dispute arising out of or related to these Terms or the Service, except where mandatory consumer-protection laws require otherwise.
